Mayor: McDowell Was Not Treated Differently [Video] [Update]
Mayor Moccia says police targeted Tanya McDowell no more than they would any other suspected drug dealer in Norwalk. Police say she was carrying marijuana and crack cocaine for sale when arrested Friday.
Tanya McDowell—already facing a first-degree larceny charge for enrolling her son in a Norwalk school without being a city resident—was arraigned Monday in state Superior Court in Norwalk for posession and sale of narcotics.
McDowell appeared before Judge Bruce P. Hudock, who kept her combined bonds on the new charges, set by Norwalk Police, at $200,000.
Following her appearance, her attorney, Darnell D. Crosland, said Norwalk Police had targeted her for arrest.
"I'm outraged by what I'm seeing here," Crosland told a group of reporters in front of the courthouse following the arraignment.
McDowell had three arrest warrants outstanding when Special Services officers took her into custody Friday on Chestnut Street in the area of the Columbus Magnet School. The officers reported that at the time of her arrest, she was carrying narcotics for sale, which resulted in additional charges against her.
Assistant State's Attorney Tiffany Lockshier told Hudock McDowell was in possession of 30 small bags of marijuana and 23 bags of crack cocaine.
On Saturday, Police Chief Harry W. Rilling said officers have been observing her selling drugs in South Norwalk for weeks, and no one should expect to be able to do that "with impunity" on Norwalk streets. He said there are also two arrest warrants pending for McDowell in Bridgeport.
McDowell was charged in April with first-degree larceny for registering her 6-year-old son in Brookside Elementary School while allegedly not a Norwalk resident. She has said she is homeless and spends time in Bridgeport and Norwalk.
Her situation has drawn national attention, with proponents arguing for fairness in dealing with a homeless woman who wanted to get her 6-year-old son an education.
Police on Friday gave her address as 66 Priscilla Circle in Bridgeport.
McDowell was also arrested in November 2010 on numerous narcotics charges.
The warrants executed Friday charge her with several dozen counts of manufacturing, distributing, possessing and selling narcotics, and doing so within the vicinity of a school.
At McDowell's last appearance court appearance, when she was arraigned on the larceny charge, Crosland told Hudock that according to officials with the state's Alternatives to Incarceration program, McDowell had passed all of its requirements with flying colors, including urinalysis tests to confirm she is no longer taking drugs.
Last Tuesday, McDowell's case was the centerpiece of an "Equal Education for All" rally organized by the state national conference and Norwalk chapter of the N.A.A.C.P.
Scot X. Esdaile, president of the state conference, asked the crowd to pray for McDowell. Well-known civil rights activist Al Sharpton spoke mostly on broad themes about education and separated himself from McDowell, saying he was still looking into the case. "Let the chips fall," Sharpton said, regarding McDowell's situation.
McDowell says her son now attends a Bridgeport school.
In arguing that McDowell's combined bonds should remain at $200,000, Lockshear challenged Crosland's claim that his client was not a threat to the community, noting that police arrested her selling drugs near a school. Lockshear also pointed to the fact that McDowell has previous convictions for first-degree robbery and possession of a weapon in a motor vehicle.
Concerning his client's alleged activities so soon after being charged with felony larceny, Crosland said McDowell doesn't make the brightest decisions, but if everyone made the brightest decisions, "I would'nt have any clients."
McDowell was released from custody on the larceny charge after posting a $25,000 bond and Crosland argued no additional bond should be placed against her for the new charges.
I hope she will be able to go home and care for her child, Crosland told Hudock.
Hudock said all of McDowell's cases would be combined and then continued to July 25.
Outside the courthouse, Crosland said, "The whole thing stinks. I think the whole community should be disappointed."

Well, well, well - so this is the "honest" mother who claims innocence when she also knowingly used false addresses to enroll her kid in Norwalk schools. What a fine example of a good mother - getting caught selling drugs again. Her rap sheet is just getting longer and longer. Where is Sharpton now? The Mayor was right about McDowell after all.

The mayor and the chief get no kudos from me- I know the scope. This is police misconduct- and a mayors abuse of power.
Why did the police make 3 buys from McDowell?
Why not arrested arrested her after the first buy?
Why did they arrested her on friday?
The awswer to question one and two- If you have a low level drug dealer and you want to railroad them- you stack the deck -it is not about the charge it is about the bail- each time a low level dealer makes a sale to a undercover- they can ask 50,000 per act. So making three buy from her- the state would ask for a 150k and when the arrested her- they claim they found more drugs they added another 50,000 to her bail. Bringing the total of the bail to 200,000. To have McDowell freed- she would have to pay the ten pencent which is 20,000.
The answer to question three - they wanted her to sit in jail for the weekend-before she could see a judge.
Shame on Moccia and The Chief.

There is no "Railroad Job" here. The Police are trained professionals - let them do their job. McDowell is dangerous and now she will hopefully be off the streets and stopped from selling drugs to our youths. You have no idea what goes into criminal investigations - your ignorance clearly shows. By McDowell going back repeatedly to sell drugs clearly shows that she has no regard for the law. If she was smart, she would have stopped selling drugs and she would not have been arrested. She was not smart enough to keep away, so she was arrested.

@ Get Real, I agree with you if one is selling drugs in front of a school you are arrested on the spot. Now if McDowell gets convicted of her stealing education, and providing it is true she was selling drugs those charges will be added to her current charges. I have known people who have lived across the street from the school, and have gotten arrested for even having their own personal drugs, and they were not selling. They landed in jail for awhile. While I am for the police providing they are honest and I know of some incidents of the Norwalk Police being shady, and not so nice.

There may well be video tapes and audio recordings. The police don't tell the reporters everything, but don't bet there are no tapes. This sounds like the normal police procedure for undercover buys, followed by lab tests to verify the product really is narcotics, followed by application to the court for arrest warrants. It all takes time, nobody gets arrested for peddling fake drugs, and most case never go to trial after the defense lawyers get a look at the evidence.

This was a street level dealer not a drug king pin- so let me wrap my mind around the police point. If a person is selling drugs in front of a school- the police will not take them down day one- they will watch for weeks and make three buys? Thank you to the authors for this article. This is the best coverage, and moreover the best debate comments section. Special thanks to David Gurliacci for moderating the comments!! I'm sure it's hard to find the time to do that, but unfortunately, people lose their manners and (I hope!) say things they would never say in public if they weren't hiding behind a computer screen. I've been looking for information about this online all day on and off after reading The Norwalk Hour's barely comprehensible articles in their print edition. The Hour can't seem to find someone to copyedit the *articles* before they go to print, much less deal with comments from ordinary people who aren't professional writers.

First of all can we say ENTRAPMENT...Second of all, I would like to know how much this sting cost the Police Department. To catch someone with less than $500 worth of drugs this sting was not cost effective at a time when the budget is supposed to be so tight. I'm sure it cost the police department at least $10,000. The city could have used that money to save a librarian. At the very least they could have used it to catch a dealer higher up on the food chain. No wonder the police department is so ineffective. They can't catch a murderer instead they invest large amounts of money on settling personal disputes...Third of all if you judge this woman, I would dare you to live a day in her shoes. I am not condoning selling drugs but the money she made wouldn't even gas up my car for a month. She was no big time drug dealer. In today's economy you have to do what you have to to survive. I have income coming in but its still hard. She has none coming in. Peolple committ suicide in conditions that aren't as bad as hers. Others kill themselves and their whole families over less. She's in a tough place. While normal unemployment is about 9%, unemployment for single, black, mothers is around 20-30%. So yeah she's having a tough time....Finally, laws that entitle homeless children an education are not dependent on the mother having a clean record. Homeless people hardly ever have their life together and are usually at their lowest point. The child is still entitled to an education.

The kid is enrolled in the Bridgeport school system where he lives with his family and where he belongs, so he is getting the education he is entitled to. McDowell is most likely working for high level dealers who are supplying her. Multiply the $500 worth of drugs times 7 days a week = $3,500 per week -- then you add to that the drugs she sells when she goes home to Bridgeport - now we're talking big numbers. Live a day in her shoes? She chose to wear those shoes. She needs to get a real job and work like the rest of us. There are social assistance programs out there for those who legally qualify. The money spent to get her off the streets was worth every dime.

Jabster she was not selling 7 days a week. They caught her three times over the past 3 weeks. Read the Stamford Advocate for a sell of $110 and $130. So take that. On the same ground that he is entitled to an education in Bridgeport, he was entitled to one in Norwalk. He does not have a permament residence in Brideport. Also, 75% of the money they are trying to get from McDowell was state and federal funding which he was entitled to anyway. Tired of the Republican bull. Let's get some people in that know what they are doing. Rilling and Alvord can go with Moccia. They need to stop laundering money with all these fake construction projects too. Hope the feds come take them all away soon....If you ask me McDowell probably has dirt on these Norwalk dirty cops and Moccia who is rumored to have been seen trying to buy drugs downtown.

@Deotha. Yeah, the Hour is a Republican paper. The Stamford Advocate got the affidavit and broke down the details. Not the she was right but The Hour made it sound like she was some kind of big time drug dealer when it was nothing compared to the real problem they have on the streets.

To all the folks who continue to support Ms McDowell. I agree the felony larceny charges were very unusual and nobody ever did come up with a reason why this woman was singled out of all the others for "special treatment". Those charges will probably be dismissed for a variety of reasons.
The narcotics sale cases are another matter and will probably be treated apart from the larceny case. I know how the regional narcotics task force has worked for years and it is almost unheard of for any lawyer to go to trial against the overwhelming evidence they put together before an arrest. You can believe what you want about the police targetting her, but, there was a meeting at Columbus school and a promise by the Chief to target the neighborhood after several gunshot incidents. She is charged with dealing drugs in that neighborhood. Even if other dealers got away with dealing in the same neighborhood that is not a defense anymore than pointing out to a cop who stops you for speeding that others are speeding. This same task force may have gotten other dealers that we won't hear about until after arrests are made. It is sad, but her own lawyer says she made "dumb" choices.

She was targetted. There's probably someone right now out there trying to sell drugs to kids and the cops won't do anything becuase there is no PERSONAL GAIN for them. Someone can get shot right now in front of the school but they won't put the same effort behind catching the person as they did McDowell's case becuase there is no PERSONAL GAIN for them...Wake up, like someone posted earlier, then why didn't they pick her up after the first sale. Why wait? Timing. They are playing a game. It's not about the school for sure. If they cared about the kids at Columbus they wouldn't have run the Guardian Angels out of King Kennedy. Which is way closer to Columbus then Chestnut is (where McDowell allegedly sold the drugs) and Chestnut is where the homeless shelter is, there shouldn't be any reason for Columbus students to be over there.

On that same note, then why not do 30 minutes sweeps of Chestnut if they care about the kids. They can make arrests all day. Why don't they do that if they care so much about Columbus students? Rilling said his officers saw her committing a crime and then came to him to ask him what to do before taking any action. Now answer me this, if she was selling drugs and committing a crime WHY DID THIS OFFICER HAVE TO GO TO RILLING TO ASK FOR INSTRUCTIONS ON HOW TO PROCEED? It seems to me the natural step after seeing someone commit a crime for a police officer is to go arrest them (we all agree her actions in selling drugs were wrong and illegal and none of us happen to be law enforcement so why didn't this officer know what to do?). Don't they teach that at the academy? Why would he even assume she should get a free pass? Is that what they do in the Norwalk PD?... Now tell me she wasn't targetted. Of course it wasn't the smartest move on her part but yeah, the could have picked her up after the first sale and prevented her from further distributing over the next few weeks. Chief Rilling and his boys are letting the good times role, your tax dollars- folks and Moccia supports this fleecing! How much crack did they get off the street- 23 bags of crack-which is about 30 bucks worth wholesale and 230 bucks worth retail.
I am hearing - they spent thousands of dollars and used up a few hundred man hours- for what? A low level drug dealer-that a patrolman-could have jumped out and arrested McDowell- in the act.

That POST story has some facts in it, but the author takes those facts and a very limited knowledge of how a regional narcotics task force works and jumps to some amazing conclusions. To suggest that a large volume of paperwork on someone with multiple arrests proves the police are targetting her above similar efforts against others, shows a real lack of knowledge about police work. McDowell would probably not get a lot of Norwalk Police votes for mother of the year, but they do not have the resources nor the motivation to target her or any other drug dealer. The Columbus school neighborhood has been a problem. There has been gunfire during school hours. There was a meeting with school parents and faculty where Chief Rilling promised increased attention to that neighborhood. If you read the POST article carefully, you will see the officers had to identify her from a photo lineup and had no idea who she was when they first bought from her. The multiple buys are pretty standard practice, for a number of reasons, one of which is to negate a defense argument that a purchase was a once-in-a-lifetime event, and the accused is not a real dealer. Don't be too surprized to find that other dealers were caught in the same area and their names will only be revealed after they are arrested. Very few of these cases ever go to trial, because the evidence tends to be overwhelming and the police prefer to avoid identifying the undercover officers.

It is way past time for a change in the Mayor's office, but there is no scandal in McDowell's arrest for dealing drugs.
The Mayor's unfortunate comments when she was charged with felony larceny for sending her son to Brookside school are an embarassment that attracted more attention to that case than it deserved.

I did not say the Norwalk police did not know her. This was a regional narcotics task force effort. The buys were made by undercover cops from other depts. (stamford, in this case). The "identify her from a photo lineup" was something I took from a story in the POST where a reporter was shown a large file and some of the content.
Regional Narcotics task forces have worked in this area for many years. Norwalk officers worked undercover in other towns, cops from other towns worked undercover in Norwalk. Despite what you may read here, she is not that important to the Norwalk Police. The neighborhood around Columbus school and a short distance from Police Hqs was a problem with gunshots during the day near the school. The Chief listened to complaints from parents and faculty and promised to focus a lot of attention on the neighborhood to make it a safer place for a school. One of the resources he used was a regional narcotics task force which has been working Fairfield County for years very effectively. The fact that this woman got caught is the result of some very poor decisions she made. It is a shame to see anybody get caught up in dealing drugs, but don't blame the police. They were looking for drug dealers and she came along. Do you want me to tell you they were sorry she did ? They were looking for results and would have grabbed me if they caught me dealing, and I am a retired norwalk Cop.

This was a huge taskforce that cost the taxpayers of Norwalk thousands of dollars. This money could have been used to save a job or by a new police car. However, the Moccia/Rilling team decided to target McDowell- because she was winning the PR WAR.
Moccia/Rilling fleeced this community and surrounding towns- this was a over the top -political payback arrest.
Moccia/Rilling did not get the memo- this is not the deep south- during the 1960's- they are both out of steps with the mainstream.
If the repubicans nominate Moccia- they are going to send the whole ticket down in flames.

As a regional task force, a number of agencies are involved. This was not a task force put together by Norwalk police and the cost to Norwalk was probably minimal. At most, Norwalk may assign an officer or so for work outside Norwalk, but I don't know the extent of Norwalk's participation. Any town that has drug dealers routinely supports the regional task force and gets help from it.

Neither of us knows what information was given in the "tip". If someone reported Ms McDowell was selling drugs near the school or if it was reported there was an ongoing outdoor market near the school where drugs were being sold. One of the stories reports that at least one sale took place in another part of town. Once a first sale takes place, the undercover cop will meet the dealer wherever the dealer agrees to meet. I have not seen any police files or talked to anyone involved in the case, so I am just making educated guesses based on my own experience and the bits and pieces published in various places. It would be very hard for me to believe the Norwalk Police asked a regional task force to work in Norwalk for the sole purpose of getting more charges against one person. That is just not how it works and the Chief would be risking his credibility with the agencies involved if he were to make such a request. Usually, the requesting chief has to indicate he has a drug dealing hotspot where there is potential to get a number of bigger dealers.
